Terms of Service

These terms are an agreement between you and FiveStar ("FiveStar", "we", "us"), which runs FiveStar at askfivestar.ai and this website. By using FiveStar you agree to them. If you do not agree, please do not use FiveStar.

Who can use FiveStar​

You must be at least 13 years old to use FiveStar, and old enough to agree to these terms where you live (or have a parent or guardian agree for you). Some features may have a higher age, which the app will tell you about. You are responsible for what happens under your sign-in, so keep your sign-in account secure.

What FiveStar is, and what it is not​

FiveStar is a personal AI concierge. It suggests places, plans and directions, and answers questions, using AI models and map, place, weather and web data. AI can be wrong. Opening hours, prices, events, directions, travel times, weather and other details may be out of date or incorrect. Check anything that matters (a reservation, a flight, accessibility, safety, a road or trail) with the venue, the carrier or an official source before relying on it. FiveStar is not a travel agent and does not book or sell travel for you.

Pay attention to where you are. Do not use FiveStar in a way that distracts you while driving or puts you or others at risk.

Your content​

You keep ownership of what you put into FiveStar: your messages, reviews, check-ins, places you add and corrections. You give us a worldwide, non-exclusive, royalty-free license to host, store, process, display and adapt that content as needed to run, improve and protect FiveStar, and, for content that is public by its nature (reviews, and places and corrections once they are confirmed), to show it to other people. For places and corrections this license continues after you delete your account, without your name, because other travelers' maps depend on them. Reviews and check-ins must be genuine​

Reviews, ratings and check-ins are only useful if they are honest. When you write a review or check in, you agree that:

  • your review reflects your own, genuine experience of the place;
  • you are not reviewing a place you own, work for, or compete with, and you have not been paid, given anything of value, or offered a discount in exchange for the review or rating;
  • you check in only where you actually are, and you do not fake or alter your location, or use multiple accounts, automation or other tricks to inflate check-ins, ratings or a place's standing;
  • your content is lawful and does not harass anyone, contain hate speech, reveal someone else's private information, infringe anyone's rights, or include spam or advertising.

We may remove, hide or decline content, or discount check-ins, that we believe breaks these rules, and we may suspend accounts that do.

Venues and offers​

Places shown in FiveStar are independent businesses. If a venue offers you a deal, discount or other offer through FiveStar, the offer is made by that venue, not by FiveStar. The venue is responsible for the offer, its terms, and honoring it, and for the goods and services it provides. Offers in FiveStar are always labeled as offers and never buy a place's ranking, reviews or check-ins. We are not responsible for a venue's products, services, conduct or failure to honor an offer, though we want to hear about it at support@askfivestar.com.

Connected accounts​

If you connect an email account, calendar or forwarding address, you confirm that it is yours and that you have the right to let FiveStar read it as described in the Privacy Policy. You can disconnect at any time.

Acceptable use​

Do not misuse FiveStar. In particular, do not:

  • try to get into accounts or data that are not yours, or test, probe or break FiveStar's security;
  • scrape, copy or harvest FiveStar's data or other people's content, or use FiveStar to build a competing product or dataset;
  • send automated traffic or load that degrades the service;
  • use FiveStar for anything unlawful, or to plan harm to anyone.

Third-party services​

FiveStar relies on services we do not control, such as sign-in providers, map tiles, weather data and web search results, and links to other websites. Their own terms and policies apply to them, and we are not responsible for their content or availability.

Changes, suspension and ending​

FiveStar is evolving. We may add, change or remove features, and we may suspend or end the service, with notice where reasonable. You can stop using FiveStar at any time and delete your data as described in Delete your data. We may suspend or close your access if you break these terms or if we must for legal reasons.

Disclaimers​

FiveStar is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement, and we do not promise the service will be uninterrupted or error-free.

Limitation of liability​

To the extent the law allows, FiveStar will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data, travel plans or opportunities, arising from your use of FiveStar. Our total liability for any claim relating to FiveStar is limited to the greater of the amount you paid us for FiveStar in the 12 months before the claim, or US $50. Some places do not allow these limits, so they may not apply to you, and nothing in these terms limits rights you have under consumer law that cannot be waived.

Indemnity​

If you use FiveStar in breach of these terms or the law, and that leads to a claim against FiveStar, you agree to cover our reasonable losses and costs from it, to the extent the law allows.

Governing law​

These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law rules, except where the law of the place you live requires otherwise. Any dispute will be heard in the state or federal courts located in Delaware, unless the law of the place you live gives you the right to bring it at home.

Changes to these terms​

If we change these terms, we will update the date at the top, and for material changes, tell you in the app before they take effect. If you keep using FiveStar after that, the new terms apply.
